Keith, Is it realistically possible that French court will award those sort of figures and have you any idea if insurance would cover? I cannot imagine Nantes have a pot to piss in.

If the documentation proves that McKay was working for Nantes, then because of vicariously liability Nantes would be deemed as having arranged and paid for the flights even though they didn't do so directly or were even aware of the arrangements. They are ultimately responsible for their employee/agent/sub-contractors negligence.

It is the same as say a plumber working for a company who damages your bathroom. He personally wouldn't be liable to pay for the damage the plumbing company would.

The point would be who was McKay invoicing for arranging the flights? Nantes, Cardiff, Sala? Because I don't believe for one moment he was doing it out of the kindness of his heart.

He was playing the big man. Look I’m the fixer, I can sort you the flight. He was on to get £1,5m allegedly from the deal, so a few hundred quid for his mate for the flight was nothing. Enhances his reputation for getting the players looked after… only it didn’t work out like that

This thread was going off on a tangent until dml1954 corrected the whole point of this case. Clearly it took the Court cases against McKay to get the relevant proof that he was acting for Nantes who paid and arranged for the dodgy flight. Of course had the tragedy not happened nothing more would have been said but in the circumstances the club has a point and were right to pursue the matter.

As far as I’m aware McKay agreed to provide the information and documentation etc.. when threatened with court, then failed to do so and us now being sued for contempt of court.

He’s definitely hiding something that will have a serious effect on him, either showing that he was aware the flight pilot was being changed or blowing Nantes defence open.
I’ve also heard Keta is not a nice man and it’s possible McKay is being leaned on.
