If he was tried in Scotland - it would probably be case unproven. Plenty of evidence against him - but if the other side wont testify - there is little chance of conviction.

England / Wales - no case to answer I guess seeing as the CPS pulled the case. Anyone who sh@gs their brothers wife for 8 years behind his back - has to have some questions asked about his character.
