Really bad PR, but if the tree isn't protected with a Tree Protection Order (and I haven't read that it was) and it's on your land you can pretty much do what you like with it, especially so if someone starts you to a potential risk which makes not acting upon that advice all the greater a risk.
There were clearly other options in this case, but I can see how it happens.
