    Surely it certainly doesn't imply consent to 'another person being phoned to come round and join in' - especially after she had got increasingly worse for drink .

    BUT

    she cannot remember any of it happening, so she cannot remember consenting or not

    Yes Ched is a wrong un, but how many other blokes would have been tempted to " have a go " with her if she was encouraging it ? ? ?

    Quite - she was so drunk, she didn't wake up when she pissed herself later that night. Evans should have known that she was extremely drunk: the only contact he'd had with her outside the room was when he stepped over her, literally falling down drunk, earlier.

    It also gives the lie to the idea that she made a complaint to make money. No, she didn't know where her handbag was and thought it had been stolen. In fact, she'd left it in the kebab shop around 3am. Just how drunk does a woman have to be to not know where her handbag is?

    Where's the evidence that she was encouraging it?

    He says she was "repeatedly" "calling out" "**** me harder", but MacDonald doesn't say he heard that before he left the room. Evans' brother and the mate outside trying to film it all didn't give evidence that they could hear that (and they could be heard giggling from inside the room, so would clearly be able to hear someone "calling out" inside it). The night porter who could hear that sex was happening in the room couldn't hear that.

    So of the four people in a position to hear all this claimed encouragement, none could. Hmm...

    nope, you're right it doesnt. but does it imply consent with the fella she was chatting to in a bar?
