Re: The new Bosman?
The whole concept of 'buying' players is bonkers when you stop to think about it.Originally posted by Undercoverinwurzelland View PostThis ruling could have implications for football transfers as significant as the Bosman one

What if, in real life, Jones Motors had a top mechanic and Evans Garage wanted him. There would be no transfer fee he'd hand in his notice and bugger off. Or if he was on a fixed term contract compensation would be paid.
I'll never understand how football, and a few other sports, are such an exception.

Re: The new Bosman?
It'll be interesting to see how this affects transfers, I thought football had some form of exemption from some employment rules due to the fear the sport would collapse, clubs would go under and loads of people would end up out of work as a result if transfer fees were banned.
The initial complaint stemmed from someone having their contract terminated and then prevented from joining a new club which obviously can't be right. But the contract was terminated because the player was refusing to train and play so perhaps the player should owe the club in this scenario for breach of contract.

Re: The new Bosman?
Under EU law a player over the age of 24 can terminate his contract at any time by "paying it up" (as can any worker on a fixed term contract), the exemption for football under the freedom of movement rules is that this does not apply to players under 24 as this would unduly complicate and compromise the development of young players.Originally posted by PontBlue View PostIt'll be interesting to see how this affects transfers, I thought football had some form of exemption from some employment rules due to the fear the sport would collapse, clubs would go under and loads of people would end up out of work as a result if transfer fees were banned.

As you state this case is about a club terminating a players contract and then trying to prevent his employment elsewhere by effectively retaining his registration by refusing to complete the documentation to authorise transfer of registration between different international jurisdictions.

Re: The new Bosman?
I'm not saying you're wrong but if that is the case how are there such huge transfer fees paid. Even for a player on 100k a week with 4 years left the 'pay up' amount is roughly £20m???Originally posted by JumpersforGoalposts View PostUnder EU law a player over the age of 24 can terminate his contract at any time by "paying it up" (as can any worker on a fixed term contract), the exemption for football under the freedom of movement rules is that this does not apply to players under 24 as this would unduly complicate and compromise the development of young players.

I would expect that the majority of players would not fancy the financial risk involved nor the "reputational" risk of exercising their rights in this sort of scenario.Originally posted by PhyllisStant View PostI'm not saying you're wrong but if that is the case how are there such huge transfer fees paid. Siopis was said to have bought his contract out to join Bulut's "project" in Cardiff, although AFAIK he only had six months or so left on his contract.
