It's worth catching up on the "no one is above the law" prosecution of James Comey.
In summary.
Comey was charged following a Truth Social Post from Trump to Pam Bondi questioning why no charges had been brought against him.
Bondi immediately sacked the Justice Department prosecutor who had concluded that there was no case likely to result in a prosecution. She replaced him with Lindsay Halligan, one of Trump's many personal legal representatives. She specialised in insurance law with no prosecution experience. Appointments of that nature normally require Judicial ofr Congressional approval.
She "convinced" a Grand Jury to take forward two out of the three charges. Comey's initial defence is that the case should not be heard because:
a) The prosecution was a vindictive act and
b) Halligan was illegally appointed and hasd no jurisdiction.
These two strands are being heard by two different judges.
On the first defence the Judge has ordered all the Grand Jury testimony to be turned over to the defence on reports that Halligan misdirected the Jury and there are missing elements in what the Judge was privy to see.
On the second a second Judge found out yesterday that Halligan failed to present a new indictment to the full Jury, rather got the Foreman only to witness and sign. Likely to invalidate the affidavit and something on the first page of the Prosecutor For Dummies handbook.
All the while Bondi has twice testified to court that she is satisfied with the process followed and all materials have been satisfactorily provided. As a result Ty Cobb, an ex-Trump lawyer has suggested that there is sufficient malpractice and incompetence to get Bondi and Halligan struck off.
I guess that is what you get when you appoint people for their slavish loyalty rather than their competence!
Halligan is also the prosecutor leading the Letitia James (Big Tish) prosecution. Bet she is shaking in her boots!
