    FFS she didn’t get caught, she made a genuine mistake. It happens to the best of it. She’s been cleared move on or it will eat away at you

        It is the fixed penalty regime that I have an issue with. For want of repeating myself a taxpayer may have to file a return even though they owe no tax, and end up being penalised up to £1600 per tax year if they do not. This penalty is a late filing penalty and nothing to do with schedule 41. Someone leaving the workplace having paid tax via PAYE all their lives may unwittingly have to file a return if they receive a lump sum gratuity, and if the return is not filed after 12 months, they have fixed penalties of £1600. This would need to be paid and would be taking funds from a pensioner who has no further earning potential to cover such a fine.

        And you think this is acceptable. Just how heartless are you?
        Late filing penalties are Sch 55 but you probably know that.
        In your example, if someone isnt registered for SA how can a Sch55 penalty be issued if there is no return to file late? They would have until 5 October to register for SA, file a return and pay any tax due by 31 Jan the following year. A Sch41 could be issued, but a late filing penalty would only be applied on 1 Feb.
        Im not heartless at all, just referring to the rules that have been in place for years.

          She got caught, she was found out. She didn't volunteer the correction it was hoisted upon her.

            If someone isnt registered then subsequently files a return after the due date, hmrc dont treat this as being late. HMRC assume a notice to file was issued on the date the return was received and the taxpayer is given the statutory 3 months to file from the date of notice. Ergo no penalty.

            Thats not what I am discussing.

                  Youre talking about Sch55 late filing penalties which i have referred to.

                  Anyway, im amazed myself that Angela Raynor didnt have a penalty applied on top of her £40k. Her advisor told her to seek specialist advice on the tax position of the purchase as Stamp Duty wasn't their area of work. She didnt. Not seeking specialist advice, when told to do so, is not a reasonable excuse, so a careless penalty could easily have been applied. The timing of it being settled, a day or 2 after Starmers position became more vulnerable, also seems questionable.

                        Being careless doesnt always mean a penalty has to be paid. It really does depend on how cooperative the taxpayer is during the enquiry. I suspect Raymor had a penalty, but it was suspended.

                        In relation to late filing penalties, I'm referring to penalties being applied even when no tax is due.

                          I thought we had moved onTBH but you came in with some fantasy about a mistake and looking for apologies 🤣🤣🤣, it seems to be eating you up that Ange got caught, the Farage got caught as well and for a far bigger sum of money, politicians will always be politicians. It gets far easier when you acknowledge the crooks with different colour rosettes don't give a F about you and me and will do and say anything to mask their dishonesty.

                            She said HMRC concluded she wasn't careless and there was no wrongdoing. If thats the case there was no penalty.

                              Now you mention it she did say that and I cant see how. If there is an error in a return then the starting position is always careless. Raynor certainly didn't take reasonable care
